An Australian woman will give birth to her first child without the support of her partner after the Immigration Department denied a visa to her British boyfriend.

Gold Coast resident Zoey Madden, 35, is five months pregnant with partner Alex Musson, after the pair met last year.

Mr Musson travelled to New Zealand to lodge a temporary visa earlier this month but had his application rejected on Friday.

It may take up to 18 months for his partner visa to be processed, leaving Ms Madden alone entering the final trimester of her pregnancy.

'When we got the refusal letter last Friday we were just absolutely devastated. Alex was just crying, he was a shattered man,' Ms Madden told Nine.

He is devastated because his child is going to be born and he won't be here.'

Ms Madden, who is a registered nurse, and Mr Musson, who owns a Gold Coast cleaning and pest control company, met last year and discovered they were pregnant in May.

The British citizen originally came to Australia in 2010 on a tourist visa, before applying for a partner visa after entering a relationship with an Australian woman. The application was withdrawn when they broke up in 2014.

He has been living in Australia on sponsored and bridging visas since, and flew to New Zealand in early September to apply overseas for another tourist visa.

'We just don't understand how this can happen. We are both working. Both paying taxes,' Ms Madden said.

'Alex owns his own business and he employs an Australian citizen, he has contractors that work for him as well.'

Mr Musson penned an emotional plea to the Immigration Department asking for them to grant the visa on compassionate grounds, saying without him being present his pregnant partner would have to rely on government funding.

'This will now cause my partner unnecessary stress which may have effects on our unborn child,' he wrote.

Ms Madden and Mr Musson are able to lodge an appeal to the ruling, but it will cost them $1,700. They say they have already spent more than $50,000 on visa and legal costs

However, the pair were formally notified of the failed application on Friday because they were not satisfied he would be remaining in Australia on a temporary basis.

'I have considered the circumstances including that applicant's partner is pregnant, but I am not satisfied that the genuine temporary stay requirement is met,' the letter from the Immigration Department reads.

The mother-to-be has created a petition to garner support and ask on Immigration Minister Peter Dutton to intervene and allow her partner to be there during her final months of pregnancy and the birth of their child.

The petition already has nearly 2,500 signatures.

Daily Mail Australia has contacted the Immigration Department for comment.
