Abstract

The digital content supply unit inserts a transaction identifier for identifying a transaction into digital contents as a digital watermark, generates transaction information including license definition information on the usage of the digital contents, stores the generated transaction information in one-to-one correspondence with the transaction identifier, and provides a user with the watermarked digital contents.

MONITORING ILLEGAL USE OF DIGITAL CONTENTS, APPARATUS
FOR PROVIDING DIGITAL CONTENTS, AND APPARATUS FOR
MONITORING ILLEGAL USE OF DIGITAL CONTENTS
BACKGROUND OF THE INVENTION
The present invention relates to a method of providing digital contents, a method of monitoring illegal use of digital contents, an apparatus for providing digital contents, and an apparatus for monitoring illegal use of digital contents. More specifically, the present invention relates to a digital content supply method and apparatus for providing digital contents embedded with digital watermarks to prevent illicit use, and a digital content illegal use monitoring method and apparatus for monitoring illegal use of digital contents by extracting digital watermarks embedded in digital contents.
A first such conventional technology, Japanese Patent JP-A-8-292976, discloses a technology which prevents illicit use of works by embedding therein their registration numbers and information on whether secondary use of the work is allowed or not.
A second such conventional technology, which includes "Information Processing" published by Information Processing Society, Vo. 38, No. 9 (ISSN
0447-8053), pp 788-789 and "Digital Watermarks" by Akira Inoue (ISBN4-89542-148-1), plll, discloses a technology which prevents illicit use of digital contents by adding to digital contents information on copyright, compensation, condition of use and destinations of delivery in the form of digital watermarks.
In the first conventional technology, because what is embedded in a work is only its registration number and information indicating whether secondary use of the work is allowed or not and because information on the condition of use and delivery destinations are not embedded in the work, the secondary use and the redistribution of the work against the condition of use cannot be prevented.
In the second conventional technology, because information on the condition of use and delivery destinations are also embedded in digital contents as digital watermark, the secondary use and the redistri-bution against the condition of use can be prevented.
However, if the digital watermark contains the condition of use and the delivery destinations, it would be large in data amount, and the partial cropping of the digital contents would result in the digital watermarks being cut off. Hence, this technology cannot prevent the illegal use of the partially cut off or cropped digital contents.
SUMMARY OF THE INVENTION
The object of the present invention is to provide a digital content supply method, a digital content illegal use monitoring method, a digital content supply apparatus and a digital content illegal use monitoring apparatus, all capable of preventing the secondary use and the illicit redistribution that violate the condition of use and also preventing the illicit use of the partially cropped digital contents.
According to a first aspect of the present invention, there is provided a digital content supply method which comprises the steps of: inserting a transaction identifier as a digital watermark into digital contents, the transaction identifier being used to identify a transaction for providing the digital content; generating transaction information including license definition information on the usage of the digital content; storing the transaction information in one-to-one correspondence with the transaction identifier; and providing a user with the watermarked digital content.
With the digital content supply method accord-ing to the first aspect of the invention, a transaction identifier with a small amount of data is used as a digital watermark and transaction information with a large amount of data is not used as a digital watermark.
Thus, even when parts of the digital contents get cut off or cropped, the digital watermark remains intact without being divided. By extracting the digital watermark from the partially cropped digital contents and retrieving the transaction identifier from the digital watermark, it is possible to obtain the license definition information from the transaction information that was stored in one-to-one correspondence with the transaction identifier. Based on the license definition information, secondary use and illicit redistribution that violate the condition of use can be detected. That is, illegal usage of the partially cropped digital contents can be prevented.
According to a second aspect of the present invention, there is provided a digital content illegal use monitoring method which comprises the steps of:
extracting a digital watermark from a digital content;
acquiring transaction information from a storage by using a transaction identifier contained in the digital watermark; and deciding whether or not the digital contents are illegally used, based on license definition information obtained from the transaction information and on the contents or form of the digital contents from which the digital watermark is extracted.
With the digital content illegal use monitor-ing method according to the second aspect of the invention, illicit usage of digital contents is detected based on the license definition information which is obtained from the transaction information that was stored in one-to-one correspondence with the transaction identifier. Thus, only the transaction identifier with a small amount of data needs to be used as a digital watermark and the transaction information with a large amount of data does not need to be used as a digital watermark. Therefore, even when parts of digital contents are cut off or cropped, the digital watermark can remain intact without being divided. It is therefore possible to prevent secondary use and illicit redistribution that violates the condition of use.
According to a third aspect of the present invention, there is provided a digital content supply method which comprises the steps of: inserting a combination of a transaction identifier and a provider identifier as a digital watermark into digital contents, the transaction identifier being used to identify a transaction for providing the digital contents, the provider identifier being used to identify a provider of the digital content; generating transaction information including license definition information on the usage of the digital contents; storing the transaction informa-tion in one-to-one correspondence with the transaction identifier; and providing a user with the watermarked digital contents.
With the digital content supply method accord-ing to the third aspect of the invention, the digital watermark includes the provider identifier in addition to the transaction identifier. This makes it possible to perform monitoring on illicit use of digital contents independently for each provider, in addition to producing the effects of the digital content supply method according to the first aspect.
Using a provider identifier issued by a third party organization can objectively authenticate the digital watermark used. The third party organization refers to an impartial organization specializing in the distribution of digital contents, such as Music Society of Japan in music industry.
According to a fourth aspect of the present invention, there is provided a digital content illegal use monitoring method which comprises the steps of:
extracting a digital watermark from digital contents;
when a provider identifier in the digital watermark is the one to be monitored, acquiring transaction informa-tion from a storage by using a transaction identifier contained in the digital watermark; and deciding whether or not the digital contents are illegally used, based on license definition information obtained from the transaction information and on the content or form of the digital contents from which the digital watermark is extracted.
With the digital content illegal use monitor-ing method according to the fourth aspect of the invention, only when the provider identifier is the one to be monitored, the decision is made on whether or not the digital contents are illegally used. Hence, it is possible to perform monitoring on illicit use of digital contents independently for each provider, in addition to producing the effects of the digital content illicit monitoring method according to the second aspect.
According to a fifth aspect of the present invention, there is provided a digital content supply apparatus which comprises: a digital watermark insertion unit for inserting a transaction identifier as a digital watermark into digital contents, the transaction identifier being used to identify a transaction for providing the digital contents; a transaction informa-tion generation unit for generating transaction information including license definition information on the usage of the digital contents; a transaction information storage unit for storing the generated transaction information in one-to-one correspondence with the transaction identifier; and a digital content supply unit for providing a user with the watermarked digital content.
With the digital content supply apparatus according to the fifth aspect, it is possible to suitably implement the digital content supply method according to the first aspect.
According to a sixth aspect of the present invention, there is provided a digital content illegal use monitoring apparatus which comprises: a digital watermark extraction unit for extracting a digital watermark from digital contents; and an illegal use decision unit for acquiring transaction information stored in the transaction information storage unit by using a transaction identifier contained in the extracted digital watermark, and for deciding whether or not the digital contents are illegally used, based on license definition information obtained from the g transaction information and on the content or form of the digital content from which the digital watermark is extracted.
With the digital content illegal use monitor-s ing apparatus according to the sixth aspect, it is possible to properly implement the digital content illegal use monitoring method according to the second aspect.
According to a seventh aspect of the present invention, there is provided a digital content supply apparatus which comprises: a digital watermark insertion unit for inserting a combination of a transaction identifier and a provider identifier as a digital watermark into digital contents, the transaction identifier being used to identify a transaction for providing the digital contents, the provider identifier being used to identify a provider of the digital contents; a transaction information generation unit for generating transaction information including license definition information on the usage of the digital contents; a transaction information storage unit for storing the generated transaction information in one-to-one correspondence with the transaction identifier; and a digital content supply unit for providing a user with the watermarked digital contents.
With the digital content supply apparatus according to the seventh aspect, it is possible to properly implement the digital content supply method _ g _ according to the third aspect.
According to an eighth aspect of the present invention, there is provided a digital content illegal use monitoring apparatus which comprises: a digital watermark extraction unit for extracting a digital watermark from a digital content; and an illegal use decision unit for acquiring transaction information stored in the transaction information storage unit by using a transaction identifier contained in the extracted digital watermark when a provider identifier in the extracted digital watermark is the one to be monitored, and for deciding whether or not the digital contents are illegally used, based on license definition information obtained from the transaction information and on the content of the digital content from which the digital watermark is extracted.
With the digital content illegal use monitor-ing apparatus according to the eighth aspect, it is possible to properly implement the digital contents illegal use monitoring method according to the fourth aspect.
According to a ninth aspect of the present invention, there is provided a digital content illegal use monitoring apparatus as described in the sixth or eighth aspect, which has a data collection unit for collecting digital contents made public on a network.
With the digital content illegal use monitor-ing apparatus according to the ninth aspect, it is possible to prevent illegal digital contents from being distributed over a network.

DETAILED DESCRIPTION OF THE EMBODIMENTS
Embodiments of the present invention will be described by referring to the accompanying drawings. It should be noted that these embodiments do not limit the invention in any way.
- First Embodiment -Fig. 1 is a block diagram showing the basic configuration of a according to a first embodiment of the invention.
The digital content transaction system 1 includes a user terminal 10 and a digital content supply/management apparatus 20 interconnected with each other over a network 100.
The user terminal 10 is a computer, such as a personal computer or a TV game device, that is installed with application software dedicated for providing digital contents.
The digital content supply/management apparatus 20 is, for example, a workstation and includes a digital content supply unit 21, a digital content illegal use monitoring unit 25, a provider site identifier (ID) storage unit 29 for storing a provider site identifier used to identify the digital content supply/management apparatus 20, a digital content information storage unit 30 for holding digital content information (300 in Fig. 3) described later, a license definition information storage unit 40 for holding license definition information (400 in Fig. 4) described later, and a transaction information storage unit 50 for holding transaction information (500 in Fig. 500) described later.
The digital content supply unit 21 includes a watermarking data generation unit 22 for generating watermarking data (600 in Fig. 6) described later, a digital watermark insertion unit 23, and a transaction information generation unit 24.
The digital content illegal use monitoring unit 25 includes a data collection unit 26, a digital watermark extraction unit 27, and an illegal use determination unit 28.
Fig. 3 shows the structure of each digital content information 300 held in the digital content information storage unit 30.
The digital content information 300 includes a digital content identifier (ID) 301 for uniquely identifying a digital content body, digital content attribute data 302, and digital content body data 303.
The digital content attribute data 302 includes catalog data 321, which contains such information as will be found in general good catalogs such as price, size and sample data, and property right data 322 such as information on copyright of the digital content of interest and compensations for a copyright holder.
The digital content body data 303 is digitized data, such as image data, video data, voice data, text data and programs, that have values in distribution.
Fig. 4 illustrates the structure of each license definition information 400 held in the license definition information storage unit 40.
The license definition information 400 includes a license identifier 401 for uniquely identifying the license definition information, a digital content identifier 402 for digital contents provided under the license, and license detail data 403 specifying usage conditions for the provided digital contents and measures taken in the event of a violation of the conditions.
Two or more license definition information 400 may be defined for each set of digital contents.
Fig. 5 illustrates the structure of each transaction information 500 held in the transaction information storage unit 50.
The transaction information 500 includes a transaction identifier 501 for uniquely identifying the transaction information, a license identifier 502 for a license provided by this transaction, and distribution destination data 503 or information on authorized users to whom the license is made available.
Information on authorized users may be acquired by requesting such information from the users when supplying digital contents. Alternatively, the digital content supply/management apparatus 20 may have a membership registration function that acquires the information at time of membership registration.
Fig. 6 illustrates the structure of water-marking data 600 generated by the watermarking data generation unit 22 of the digital content S supply/management apparatus 20.
The user terminal 10 and the digital content supply/management apparatus 20 send and receive informa-tion to and from each other over the network 100. Here the Internet is utilized as a base, with a WWW browser installed at the user terminal 10 and a WWW server installed at the digital content supply/management apparatus 20.
Fig. 2 shows a flow of process for providing digital contents.
Of the following steps, steps 214-216 are pertinent to the present invention.
- Step 201 The user sends a request for information on digital contents available from the user terminal 10 to the digital content supply/management apparatus 20.
- Step 211 Upon receiving the request for information on the digital contents available, the digital content supply/management apparatus 20 transmits to the user terminal 10 one or more digital content attribute data 302 in the digital content information 300 held in the digital content information storage unit 30.

- Step 202 Based on the one or more digital content attribute data 302 received, the user selects a digital content he or she wants to receive and sends a request for the digital content body data 303 of interest.
- Step 212 Upon receiving the request for the digital content body data 303 from the user terminal 10, the digital content supply/management apparatus 20 retrieves the license definition information 400 on the requested digital content from the license definition information storage unit 40 and sends it to the user terminal 10 together with a request for a reply indicating whether the user agrees to the license.
- Step 203 The user sends to the digital content supply/management apparatus 20 his reply indicating whether he consents to the license definition information 400 received.
- Step 213 When a consent to the license definition information 400 is not obtained, the digital content supply/management apparatus 20 returns to the step 211 where it waits for another request for digital contents.
When a consent to the license definition information 400 is obtained, the digital content supply/management apparatus 20 proceeds to step 214.

- Step 214 The digital content supply/management apparatus 20 generates the watermarking data 600 for the digital contents to be supplied using the watermarking data generation unit 22.
Fig. 8 shows a flow of process performed by the watermarking data generation unit 22.
Step 801 retrieves a provider site identifier from the provider site identifier storage unit 29.
Step 802 generates a transaction identifier unique in the digital content supply/management apparatus 20.
Step 803 generates watermarking data 600 having the provider site identifier and the transaction identifier as its constitutional elements. The generated watermark may be compressed to a smaller size.
(Return to Fig. 2) - Step 215 The digital watermark insertion unit 23 retrieves the requested digital content body data 303 from the digital content information storage unit 30 and inserts the watermarking data 600 generated by the watermarking data generation unit 22 into the digital content body data 303.
- Step 216 The transaction information generation unit 24 generates transaction information 500 on the supply of digital contents and stores it in the transaction information storage unit 50. After the transaction information 500 is stored, the transaction information generation unit 24 transmits the watermarked digital content body data 303 to the user terminal 10.
- Step 204 The user terminal 10 receives the watermarked digital content body data 303 from the digital content supply/management apparatus 20.
If the digital content supply/management apparatus 20 uses as watermarking data only the transaction identifier 602 that can be generated arbitrarily by the digital content supply/management apparatus 20, the authenticity of the digital content cannot be guaranteed objectively. Hence, an impartial third party organization examines the digital content supply/management apparatus 20, assigns a provider site identifier, and manages the relation between the digital content supply/management apparatus 20 and the provider site identifier. Then the digital content supply/
management apparatus 20 receives the assigned provider site identifier via a portable storage medium such as floppy disk or via a network 100, stores it in the provider site identifier storage unit 29, and uses the watermarking data 600 to which the provider site identifier is added. This can objectively authenticate the watermarking data.
Fig. 7 is a flow diagram showing the opera-tions performed by the digital content illegal use monitoring unit 25.
- Step 701 The data collection unit 26 collects the digital content body data present on the network 100 and its location data. The data collection unit 26 is, for example, an Internet robot used by a search engine on the Internet.
- Step 702 The digital watermark extraction unit 27 extracts the watermarking data 600 from the collected digital content body data.
- Step 703 The monitoring unit 25 retrieves the provider site identifier 601 from the extracted watermarking data 600 and, if it is not its own provider site identifier, returns to the step 701. If it is its own provider site identifier, the unit moves to step 704.
- Step 704 The monitoring unit 25 retrieves the transac-tion identifier 602 from the watermarking data 600, extracts the transaction information 500 corresponding to the transaction identifier, and from the extracted transaction information 500 acquires the license identifier 502 and the distribution destination data 503.
- Step 705 The monitoring unit 25 extracts the license definition information 400 corresponding to the retrieved license identifier 502 from the license definition information storage unit 40 and then acquires the digital content identifier 402 and the license detail data 403 from the extracted license definition information 400.
- Step 706 The monitoring unit 25 extracts the digital content information 300 corresponding to the retrieved digital content identifier 402 from the digital content information storage unit 30 and retrieves the digital content attribute data 302 and the digital content body data 303 from the extracted digital content information 300.
- Step 707 The illegal use determination unit 28 compares the digital content body data and location data collected by the step 701 with the license detail data 403 retrieved by the step 705 and also with the digital content attribute data 302 and digital content body data 303 retrieved by the step 706 to check whether the digital content is legally used. This decision may be made, for example, by comparing the content and size of the collected digital content body data with those of the retrieved digital content body data 303, by estimating what kind of processing has been performed on the collected digital content body data, and by checking with the license detail data 403 to see if such processing is allowed or not. A further check is made by comparing the location data of the collected digital content body data with the retrieved distribution destination data 503 corresponding to the collected digital content body data to check whether such a distribution is allowed or not.
With this watermarked digital content transac-tion system 1, the digital content supply/management apparatus 20 can efficiently monitor illegal use of the digital contents disseminated from its site. The digital content transaction system 1 may be used, for example, in a configuration in which the digital content supply/management apparatus 20 is installed at electronic mall providers and the user terminal at general end users, with the Internet connecting the electronic mall providers and the end users. With this configuration, it is possible to check by the electronic mall whether or not the use of parts cropped from the sold digital content products is outside the contract.
- Second Embodiment -Fig. 9 is a block diagram showing the basic configuration of a digital content transaction system according to a second embodiment of the invention.
A digital content transaction system 2 includes a user terminal 10, a digital content supply apparatus 60, a digital content illegal use monitoring apparatus 70, and a digital content license management apparatus 80, all interconnected over a network 100.
The user terminal 10 is identical to the user terminal 10 used in the digital content transaction system 1 of the first embodiment.
The digital content supply apparatus 60 has the digital content supply unit 21 and the provider site identifier storage unit 29, both used in the digital content transaction system 1 of the first embodiment.
The digital content illegal use monitoring apparatus 70 has the digital content illegal use monitoring unit 25 used in the digital content transaction system 1 of the first embodiment and a monitored site identifier storage unit 71 for storing provider site identifiers of one or more digital content supply apparatuses 60 for which the apparatus 70 is requested to monitor illegal use of digital contents.
For each of the one or more digital content supply apparatuses 60 which it is called upon to manage, the digital content license management apparatus 80 includes the digital content information storage unit 30, the license definition information storage unit 40 and the transaction information storage unit 50, all used in the digital content transaction system 1 of the first embodiment.
The digital content supply apparatus 60 accesses necessary information in the digital content license management apparatus 80 over the network 100, generates watermarking data 600 and embeds it in digital contents. Then the apparatus 60 supplies the water-marked digital contents to the user terminal 10.

The digital content illegal use monitoring apparatus 70 collects a digital content over the network 100 and extracts watermarking data 600 from the collected digital contents. If the provider site identifier 601 in the watermarking data 600 is identical to the one stored in the monitored site identifier storage unit 71, the monitoring apparatus 70 uses the transaction identifier 602 in the watermarking data 600 to access necessary information in the digital content license management apparatus 80 over the network 100 to check whether or not the digital content is illegally used.
With the above-described watermarked digital content transaction system 2, because the digital content illegal use monitoring apparatus 70 performs collectively monitoring on illegal usage of digital contents over the network 100, duplicate collection of digital contents can be eliminated, which in turn reduces the amount of data transferred over the network 100, allowing efficient monitoring.
In the digital content supply method according to the invention, because a transaction identifier with a small amount of data is used as a digital watermark while transaction information with a large amount of data is not used as a digital watermark but stored in a storage, even when parts of the digital contents get cut off or cropped, the digital watermark remains intact without being divided, making it possible to extract the digital watermark even from partially cropped digital contents. Then, once the transaction identifier is retrieved from the digital watermark, it is possible to obtain the license definition information from the transaction information that is stored in one-to-one correspondence with the transaction identifier. Based on the license definition information, secondary use and illicit redistribution that violate the condition of use can be detected. That is, illegal usage of even the partially cropped digital contents can be prevented.
With the digital content illegal use monitor-ing method according to the invention, because illicit usage of a digital content is detected based on the license definition information which is obtained from the transaction information that is stored in one-to-one correspondence with the transaction identifier, only the transaction identifier with a small amount of data needs to be used as a digital watermark and the transaction information with a large amount of data does not need to be used as a digital watermark. Therefore, even when parts of digital contents are cut off or cropped, the digital watermark can remain intact without being divided. It is therefore possible to prevent secondary use and illicit redistribution that violates the condition of the use.

Claims (12)

1. A digital content supply method comprising the steps of:
inserting a transaction identifier as a digital watermark into digital contents, the transaction identifier being used to identify a transaction for providing the digital contents;
generating transaction information including license definition information on the usage of the digital content;
storing the transaction information in one-to-one correspondence with the transaction identifier; and providing a user with the watermarked digital contents.
2. A digital content illegal use monitoring method comprising the steps of:
extracting a digital watermark from digital contents;
acquiring transaction information from a storage by using a transaction identifier contained in the digital watermark; and deciding whether or not the digital contents are illegally used, based on license definition information obtained from the transaction information and on the content or form of the digital contents from which the digital watermark is extracted.
3. A digital content supply method comprising the steps of:

inserting a combination of a transaction identifier and a provider identifier as a digital watermark into digital contents, the transaction identifier being used to identify a transaction for providing the digital contents, the provider identifier being used to identify a provider of the digital contents;
generating transaction information including license definition information on the usage of the digital contents;
storing the transaction information in one-to-one correspondence with the transaction identifier; and providing a user with the watermarked digital contents.
4. A digital content illegal use monitoring method comprising the steps of:
extracting a digital watermark from digital contents;
when a provider identifier in the digital watermark is the one to be monitored, acquiring transaction information from a storage by using a transaction identifier contained in the digital watermark; and deciding whether or not the digital contents are illegally used, based on license definition information obtained from the transaction information and on the content or form of the digital contents from which the digital watermark is extracted.
5. A digital content supply apparatus comprising:
a digital watermark insertion means for inserting a transaction identifier as a digital water-mark into digital contents, the transaction identifier being used to identify a transaction for providing the digital contents;
a transaction information generation means for generating transaction information including license definition information on the usage of the digital contents;
a transaction information storage means for storing the generated transaction information in one-to-one correspondence with the transaction identifier; and a digital content providing means for providing a user with the watermarked digital contents.
6. A digital content illegal use monitoring apparatus comprising:
a digital watermark extraction means for extracting a digital watermark from digital contents;
and an illegal use decision means for acquiring transaction information by using a transaction identifier contained in the extracted digital watermark, and for deciding whether or not the digital contents are illegally used, based on license definition information obtained from the transaction information and on the content or form of the digital contents from which the digital watermark is extracted.
7. A digital content supply apparatus comprising:
a digital watermark insertion means for inserting a combination of a transaction identifier and a provider identifier as a digital watermark into digital contents, the transaction identifier being used to identify a transaction for providing the digital contents, the provider identifier being used to identify a provider of the digital contents;
a transaction information generation means for generating transaction information including license definition information on the usage of the digital contents;
a transaction information storage means for storing the generated transaction information in one-to-one correspondence with the transaction identifier; and a digital content providing means for providing a user with the watermarked digital contents.
8. A digital content illegal use monitoring apparatus comprising:
a digital watermark extraction means for extracting a digital watermark from digital contents;
and an illegal use decision means for acquiring transaction information by using a transaction identifier contained in the extracted digital watermark when a provider identifier in the extracted digital watermark is the one to be monitored, and for deciding whether or not the digital contents are illegally used, based on license definition information obtained from the transaction information and on the content of the digital contents from which the digital watermark is extracted.
9. A digital content illegal use monitoring apparatus according to claim 6, including a data collecting means for collecting digital contents made public on a network.
10. A digital content illegal use monitoring apparatus according to claim 8, including a data collecting means for collecting digital contents made public on a network.
11. A digital content providing program executing the steps of:
inserting a transaction identifier as a digital watermark into digital contents, the transaction identifier being used to identify a transaction for providing the digital contents;
generating transaction information including license definition information on the usage of the digital contents;
storing the transaction information in one-to-one correspondence with the transaction identifier; and providing a user with the watermarked digital contents.
12. A digital content illegal use monitoring program executing the steps of:
extracting a digital watermark from digital contents;
acquiring transaction information from a storage by using a transaction identifier contained in the digital watermark; and deciding whether or not the digital contents are illegally used, based on license definition information obtained from the transaction information and on the content or form of the digital contents from which the digital watermark is extracted.
